Recognition and Enforcement of Arbitration Award

Foreign awards, which are rendered in jurisdictions other than mainland China, Hong Kong, Macau and Taiwan. Depending on whether a foreign award is subject to the Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958 (New York Convention), foreign awards are further divided into New York Convention awards and non-New York Convention awards. 

If the arbitration award is made because of (i) lack of a valid arbitral agreement and (ii) failing to form the tribunal or conduct the arbitration in accordance with the parties’ agreement or the law of the seat of the arbitration, it may be denied. To this point, it is quite necessary to study before moving forward.
